1. Acceptance of Terms

By accessing or using the Human. Artistic. Collaborations. (HAC) website and services (including haccircle.com and any related subdomains) you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of the terms and conditions, you should not access or use the Website or Services.

2. Description of Services

HAC provides a platform to connect artists with individuals or organizations seeking artistic services or to purchase artistic works. Services may include but are not limited to:

  • Artist profiles and portfolios

  • Online store for purchasing artwork and merchandise

  • Event listings and ticketing

  • Information and resources related to the arts

3. User Conduct

You agree to use the Website and Services only for lawful purposes and in a way that does not infringe the rights of others, restrict or inhibit anyone's use and enjoyment of the Website and Services. Prohibited behavior includes:  

  • Harassing or causing distress or inconvenience to any other user.

  • Transmitting obscene or offensive content.  

  • Impersonating any person or entity.

  • Violating any applicable laws or regulations.

  • Attempting to interfere with the proper functioning of the Website or Services.

4. Intellectual Property

  • All content included on the Website, such as text, graphics, logos, images, and software, is the property of HAC or its content suppliers and is protected by copyright, trademarks, and other intellectual property laws.  

  • You may not reproduce, modify, distribute, or publicly display any content from the Website without the prior written consent of HAC.  

  • Artists retain copyright to their own artwork displayed on the Website unless otherwise agreed in a separate agreement.

5. Purchases and Transactions

  • If you purchase artwork or merchandise through the Website, you agree to pay the specified price, including any applicable taxes and shipping fees.

  • HAC facilitates transactions between buyers and sellers but is not responsible for the quality, safety, or legality of the goods or services provided by artists.

  • Return and refund policies will vary depending on the specific seller and will be outlined in the product listing or separate agreement.

6. Artist Agreements

Artists who use the Website to showcase or sell their work may be required to enter into a separate agreement with HAC, which will outline the terms of their participation, including commissions, payment terms, and intellectual property rights.

7. Disclaimer of Warranties

The Website and Services are provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. HAC does not warrant that the Website or Services will be uninterrupted or error-free.  

8. Limitation of Liability

HAC shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of the Website or Services, even if HAC has been advised of the possibility of such damages.  

9. Indemnification

You agree to indemnify and hold HAC and its affiliates, officers, employees, and agents harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Website or Services, your violation of these Terms, or your violation of any intellectual property or other right of any person or entity.

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions.

HAC reserves the right to modify or revise these Terms at any time, and you agree to be bound by such modifications or revisions. Your continued use of the Website or Services following the posting of any changes to these Terms constitutes your acceptance of those changes.  

12. Termination

HAC may terminate your access to all or any part of the Website or Services at any time, with or without cause, with or without notice, effective immediately.
